Nebraska’s Social Security Disability Lawyers: Lapin Law Offices

Are you disabled but the Social Security Administration (SSA) has denied your claim for Social Security Disability benefits?

There are two basic types of Social Security Disability benefits: 
  • Social Security Disability Insurance (SSDI)  
  • Supplemental Security Income (SSI)
Both of these types of disability benefits use the same definition of “disability,” which is basically that a person suffers from:
physical or mental impairment(s) of such severity that they are not only unable to do their previous work but cannot, considering their age, education, and work experience, engage in any other type of substantial gainful work existing in the national economy.
In Nebraska, the SSA initially denies a large percentage of initial applications for SSDI or SSI benefits.

The Social Security Administration has an appeal process, with time limits, that you must follow if your claim is denied. If you fail to follow SSA’s appeals process you will be required to file a new application and start the process over again. 

It can take 2 or more years to get disability benefits depending on when the SSA decides that you are disabled. If you have to file a new application the time it takes to get approved is that much longer and you can also lose out on “back benefits,” which are benefits from the day you actually became disabled and the day the SSA makes the determination that you are entitled to disability benefits.

Judge Orders Nebraska to Repay $1 Million Plus Interest

Tasha Mishra, of California, sued earlier this year after Nebraska authorities seized $1,074,900 in cash she says was her life savings earned over years as an exotic dancer. She and a friend had been pulled over for speeding. They consented to a search and the money was found. A drug-sniffing dog indicated that there was drug residue on the cash. The two were released without charges, but Nebraska state officials kept the money saying it was obtained in illegal drug trafficking.

U.S. District Judge Joseph Batallion found in favor of the woman. He indicated he was was troubled by a Nebraska State Patrol policy to convert the cash into a cashier's check and destroy the money, which means there's no way to rebut accusations that it was tainted with drug residue. In addition, he indicated that the police dog's indication of drugs on the cash was of little value as evidence, "For all the court knows, there is a 90 percent chance that all money is drug tainted."

Judge Bataillon ordered that Nebraska return the money plus interest to the woman.

Former StarTran Bus Driver Pleads Guilty to Assault

This is an update to an earlier Lapin Law Offices post: StarTran Bus Driver Fired For Hitting Passenger

The video of the March 23, 2013, bus incident was released (warning contains graphic content):

Mr. Fischer, who had been scheduled to go to trial on for assault charges related to the bus incident next week, reversed his position. On July 18, 2013, Mr. Fischer pled guilty to a misdemeanor charge of third-degree assault. The charge carries a maximum penalty of not more than one year imprisonment, or $1,000.00 dollar fine, or both. He will be sentenced to on September 18, 2013. His lawyer intends on asking for probation.
