Florida lawyer found not guilty of bribery charges

A Florida lawyer, Vincent C. Rowley, was found not guilty of bribery charges earlier this week. The case involved an "envelope stuffed with cash [$3,000] wrapped inside a newspaper" given by the attorney to a bankruptcy trustee. This fact was not disputed.

The prosecution argued it was a bribe for bankruptcy referrals.

Mr. Rowley's defense lawyer successfully argued it was a referral fee based on a referral on an earlier personal injury case.

While the lawyer was found not guilty the takeaway for all lawyers should be: Do not pay referral fees to government employees in cash wrapped inside a newspaper unless you want to experience what it is like to be a client needing good criminal defense.

Jury Finds Against Man in 8 Month Erection Case



Jurors (6 men and 6 women) took less than 2 hours to decide that there was no medical negligence following a penile implant procedure that the plaintiff alleged left him with an erection that lasted eight months. 

Defense basically argued 
that the man should have reported problems sooner than 4 months following the surgery and that he, when given the option, did not have the implant removed sooner.

Plaintiff argued he could not afford to have it removed.

The jurors refused to comment about their verdict.

It would be interesting to know why the jury decided the way it did as the implant tubing did eventually puncture the man's skin, which would seemingly indicate there was a problem with either the implant or the surgery.

My guess would be the man's delay in reporting problems. This is a common problem in personal injury cases when a a person believes things will just get better and do not seek medical attention. Jurors often hold the fact that an injured person tried to "tough it out" against them.

Automakers Trying to Force Binding Arbitration

Some automakers are trying to make consumers submit to binding arbitration instead of pursuing their claims in the courts.
"Now a few automakers are trying to do away with those resources by taking advantage of something consumers have done for decades when buying a vehicle: signing an agreement with the dealer to use arbitration to resolve disputes. Some automakers — including Honda, Toyota and Mercedes-Benz — are arguing that these sales agreements cover them, too.
Consequently, the automakers say, consumers may not use class-actions or lemon laws to get restitution. Instead, they argue, the consumer must use binding arbitration, in which the decision is final."

This is very troublesome if courts uphold these agreements and other automakers start trying to force binding arbitration. Arbitration always favors the corporation over the individual.

Walgreens to Pay Record Fine to DEA

The Drug Enforcement Administration (DEA) announced that Walgreens has agreed to pay $80 million in civil penalties for record-keeping and dispensing violations regarding Schedule II – V medications, such as oxycodone and other prescription pain killers, under the Controlled Substances Act. This is the largest fine ever paid by a company for violations of the Act.

Lawsuit Alleges "Religious" Malpractice

A Romanian lawyer filed a lawsuit against his local clergy alleging religious malpractice for failing to "exercise the demons which were responsible for the bad smells that were ruining his business" as well as haunting him in other ways. This is apparently the first Romanian lawsuit alleging "religious malpractice."
